Indemnity Agreement
As a volunteer with Midwest Honor Flight ("MWHF"), I understand that I am voluntarily participating in activities that support the mission of transporting America's Veterans to Washington, D.C., and conducting related fundraising, educational, community outreach, administrative, and operational activities. I acknowledge that volunteer activities may occur in South Dakota, Iowa, Nebraska, Minnesota, the District of Columbia, or any other location where Midwest Honor Flight conducts business.
### 1. Voluntary Participation
I understand that my participation as a volunteer is entirely voluntary. I am under no obligation to participate in any activity and may discontinue my volunteer service at any time, subject to any responsibilities I have accepted for a scheduled event or mission.
### 2. Assumption of Risk
I understand that volunteering with Midwest Honor Flight may involve risks, including but not limited to:
* Travel by automobile, bus, aircraft, or other means of transportation;
* Lifting, carrying, loading, unloading, or moving equipment or supplies;
* Setting up and dismantling event equipment;
* Exposure to varying weather and environmental conditions;
* Working around aircraft, vehicles, crowds, or public events;
* Assisting Veterans, Guardians, or other participants;
* Slips, trips, falls, or other accidents;
* Medical emergencies involving participants or volunteers; and
* Any other risks associated with volunteer service.
I knowingly and voluntarily assume all risks, whether known or unknown, foreseeable or unforeseeable, associated with my participation.
### 3. Release of Liability
To the fullest extent permitted by law, I release, waive, discharge, and covenant not to sue Midwest Honor Flight, Honor Flight Network, their officers, directors, employees, volunteers, agents, representatives, sponsors, donors, partners, property owners, transportation providers, medical providers, contractors, and affiliates from any and all claims, liabilities, demands, causes of action, damages, losses, costs, or expenses arising out of or relating to my participation as a volunteer.
This release includes claims arising from personal injury, illness, disability, death, property damage, or other losses, whether caused by negligence or otherwise, except where prohibited by applicable law or resulting from gross negligence, reckless misconduct, or intentional misconduct.
### 4. Indemnification
I agree to defend, indemnify, and hold harmless Midwest Honor Flight, Honor Flight Network, and their officers, directors, employees, volunteers, agents, sponsors, affiliates, and partners from and against any claims, demands, lawsuits, damages, liabilities, judgments, costs, or attorney fees arising from:
* My negligent, reckless, or intentional acts or omissions;
* My violation of Midwest Honor Flight policies or procedures;
* My violation of applicable federal, state, or local laws;
* My misuse of Midwest Honor Flight property or equipment; or
* My actions that cause injury, loss, or damage to another person or property.
### 5. Medical Care
I understand that Midwest Honor Flight is not responsible for providing medical insurance or health coverage for volunteers.
I authorize emergency medical treatment if I become unable to make medical decisions during a volunteer activity. I understand that I am solely responsible for all medical expenses incurred on my behalf.
### 6. Insurance
I understand that Midwest Honor Flight does not guarantee insurance coverage for volunteers beyond any insurance maintained by the organization. I am responsible for maintaining my own health, automobile, liability, and other personal insurance as appropriate.
### 7. Compliance with Policies
I agree to comply with all Midwest Honor Flight policies, procedures, safety requirements, volunteer guidelines, and directions provided by Midwest Honor Flight leadership.
I understand that failure to comply with these requirements may result in my removal from volunteer service.
### 8. Personal Property
I understand that Midwest Honor Flight is not responsible for loss, theft, or damage to my personal property while volunteering.
### 9. Photo and Media Release
I grant Midwest Honor Flight permission to photograph, videotape, record, or otherwise capture my likeness, voice, or image while participating in volunteer activities.
I authorize Midwest Honor Flight to use these materials for educational, promotional, fundraising, historical, or other lawful nonprofit purposes without compensation.
### 10. Confidentiality
During my volunteer service, I may learn confidential or private information regarding Veterans, Guardians, donors, volunteers, staff, or Midwest Honor Flight operations.
I agree not to disclose confidential information except as authorized by Midwest Honor Flight or as required by law.
### 11. Governing Law
This Agreement shall be interpreted in accordance with the laws of the state in which the volunteer activity giving rise to any claim occurs. Volunteer activities conducted by Midwest Honor Flight may take place in South Dakota, Iowa, Nebraska, Minnesota, the District of Columbia, or other jurisdictions. Venue for any legal proceeding shall lie in a court of competent jurisdiction as permitted by applicable law.
### 12. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
### 13. Entire Agreement
This Agreement constitutes the entire understanding between myself and Midwest Honor Flight regarding the subject matter herein and supersedes any prior verbal or written agreements relating to volunteer liability and indemnification.
### Volunteer Acknowledgment
By checking the box below and submitting my volunteer application electronically, I acknowledge that:
* I have carefully read this Volunteer Indemnity, Release of Liability, and Assumption of Risk Agreement.
* I understand its contents and legal effect.
* I understand that I am giving up certain legal rights by accepting this Agreement.
* I voluntarily agree to all terms and conditions contained herein.
* I certify that I am at least 18 years of age or otherwise legally authorized to enter into this Agreement.
